Terms and conditions

1. Scope and order of precedence

These General Terms and Conditions (GTC) apply to all services of Umzugsexpress GmbH, Pfadackerstrasse 9, 8957 Spreitenbach, UID CHE-364.049.074 («we»): moves and transport, assembly, clearance and disposal, cleaning, painting, storage and the sale of moving materials.

The GTC form part of the contract if the quote refers to them. They are available on our website; on request we send them free of charge or enclose them with the quote.

Order of precedence: 1. points individually agreed in the quote or job confirmation, 2. these GTC, 3. the Swiss Code of Obligations (CO). The customer’s own terms apply only if we agree to them in writing.

2. Quote and conclusion of contract

The quote is based on your details and the free survey on site or by video call. Quotes are valid for 30 days unless they state another date.

The contract is concluded when you sign the quote, confirm it by email or WhatsApp, or accept it online on your personal job page. We confirm the job in writing.

Prices, calculators and examples on the website are non-binding typical prices.

Additional services you request on the day may be agreed verbally; we record them in the completion report.

A date is only reserved once we have confirmed the order in writing (email or WhatsApp is sufficient). Until then the date may be given to someone else; if it is no longer free, we propose another one.

3. Prices and billing

Fixed price: the fixed price covers the services described in the quote, including the flat fees listed.

By effort: we charge the working time from the start of work at the first property to the end of work at the last, including travel between the properties, at the hourly rate per person. The vehicle and travel flat fee per vehicle covers the vehicle, fuel and travel there and back within the region; longer distances are stated in the quote. The minimum charge is stated in the quote.

Cost ceiling: if a cost ceiling is agreed, you pay the actual effort but no more than the ceiling. It applies to the services and conditions described in the quote.

If the actual conditions differ significantly from the details given (e.g. considerably more goods, missing or broken lift, longer carrying distances, no parking), we discuss this with you before carrying out the work. Additional work is done with your consent at the rates in the quote.

Breaks: a lunch break of up to one hour is not charged. Short breaks of 15 to 20 minutes per four hours of work count as working time.

Surcharges and third-party costs such as items over 100 kg, furniture lift, permits, disposal fees, materials or customs formalities are listed in the quote or charged according to effort. Assembly, dismantling and drilling are charged according to effort unless included in the quote.

Clearance and disposal are charged as a fixed price or by effort: working time at the hourly rate and disposal by volume and material. Hazardous waste is charged separately.

All prices are in Swiss francs including VAT unless expressly stated otherwise. For business customers the quote may show amounts excluding VAT; VAT is then listed separately.

We may adjust our rates and guide prices. For quotes you have already accepted, the agreed prices apply.

4. Customer cooperation

You provide complete and correct details of the volume, access, floors and special items (e.g. piano, safe, art, antiques).

You provide access to all rooms at the agreed time, booked lifts and – unless assigned to us – a parking space near the entrance including any permit.

You carry documents, cash, jewellery, medicines, keys and other valuables yourself.

Electrical appliances are disconnected, fridges and freezers defrosted and washing machines secured unless this is part of our job. Boxes you pack yourself are properly packed and sealed.

For cleaning, the flat is empty; electricity, water and lighting are available.

We do not transport or store gas bottles, fuel, ammunition or other hazardous substances; they must not be added to the goods.

If we cannot work, or are delayed, because of missing cooperation (e.g. no access, no parking, lift unavailable), we charge the resulting waiting time at the rates in the quote.

You provide electricity, water and light free of charge for the duration of the work.

We work with vehicles of up to 3.5 tonnes. If an address has weight or height restrictions (e.g. underground car park, courtyard entrance) or a street permit is needed, tell us before the job. You inform the neighbours and the property management about the date.

If you are not present during the work, clearly mark what is to be transported, what stays and what is to be disposed of. We are not liable for errors caused by missing or unclear marking.

5. Postponement and cancellation

You may postpone or cancel the job free of charge up to 7 days before the date. For a cancellation between 6 and 2 days before the date we charge 30 % of the job value, on the day before or on the day itself 50 %. Costs already incurred (e.g. ordered materials, permits, booked furniture lifts) are charged in any case. You remain entitled to prove that our loss was lower.

Postponement to a new date is possible subject to availability. Please notify postponements and cancellations in writing (email or WhatsApp is sufficient).

If we cannot keep a confirmed date for reasons beyond our control (e.g. force majeure, official orders, accident), we inform you immediately and offer a new date. Amounts already paid for services not provided are refunded.

6. Performance

We carry out the work carefully with suitable staff, vehicles and materials. On site a team leader is your contact.

We may involve suitable partner companies, for example for furniture lifts or special transport; we remain your contractual partner.

Existing damage to furniture, floors, walls or the stairwell is recorded together before work starts. At the end we go through the completion report together.

We mount lamps and other items on ceilings and walls only if these are suitable. Our team decides on site; we do not mount lamps on plaster, rendered or crumbling ceilings.

During the order and for twelve months afterwards you do not employ or engage our staff directly for similar work.

7. Liability, insurance and reporting damage

We are liable for damage we cause in carrying out the work in accordance with the law, in particular the provisions on contracts of carriage (Art. 440 ff. CO). Our liability as carrier is insured with Allianz Suisse (sum insured CHF 200,000 per vehicle; Switzerland, Liechtenstein and Europe under CMR). For cleaning work there is business liability insurance of CHF 5,000,000 per insurance year.

Please notify us in writing of particularly valuable items (e.g. art, antiques, collections) and their value before the job; we can arrange additional cover on request. We are liable for cash, precious metals, jewellery, securities and documents only if their transport was agreed in writing beforehand.

For the contents of boxes you packed yourself we are liable only if the box is visibly damaged or we are at fault.

Visible damage must be recorded in the completion report on delivery in the presence of our team. Damage that is not immediately apparent must be reported to us in writing with photos as soon as it is discovered, at the latest within eight days of delivery (Art. 452 CO).

We are not liable for normal wear and tear, pre-existing damage, damage due to inadequate packing by you, the internal functioning of appliances without visible transport damage, or items you transport yourself.

Liability for intent and gross negligence and for personal injury is not limited in any case.

8. Cleaning with handover guarantee

The handover guarantee applies if the flat is handed over within 3 days of the cleaning, is not used in the meantime and we are informed of the handover date. If the property manager objects to the cleaning at handover, we redo it free of charge until it is accepted. On request we attend the handover.

Damage, wear, repairs, painting and dirt arising after the cleaning are not covered by the guarantee.

The end-of-tenancy cleaning covers the empty flat: kitchen with oven, extractor hood and fridge, bathroom and toilet including descaling, windows with frames and blinds, floors, built-in cupboards and radiators. Furnished rooms are cleaned only by special arrangement.

Filling screw and nail holes and other repairs are not part of the cleaning; they belong to our painting work and are quoted separately.

9. Clearance and disposal

Items that are to remain must be clearly marked or removed before work starts. You confirm that you are entitled to dispose of the items to be cleared (e.g. as owner, heir or authorised person).

Documents, photos, cash, jewellery and other valuables we find while clearing are set aside and handed to you. Data carriers and confidential files are destroyed only on express instruction.

On removal, the remaining items pass into our ownership unless agreed otherwise; they cannot be returned afterwards. Disposal is separated and carried out properly in accordance with applicable regulations.

Hazardous waste (e.g. paint, chemicals, suspected asbestos) must be declared beforehand. If undeclared hazardous substances are found, we charge their disposal separately or decline it.

“Broom-clean” means: the rooms are empty, the floors swept or vacuumed and coarse dirt removed. End-of-tenancy cleaning for the handover is a separate service.

10. Storage

Stored goods are subject to the provisions on warehousing (Art. 482 ff. CO). Storage fees are payable monthly in advance. Storage may be terminated by either party with 30 days’ notice to the end of a month.

Please insure your stored goods against fire, water and theft (e.g. via your household insurance) unless otherwise agreed in the quote.

For outstanding claims we have the statutory right of retention over the stored goods (Art. 485 CO, Art. 895 CC). Hazardous, perishable, living or illegal goods may not be stored. Access to the depot is by appointment.

Details on storage, access, insurance and removal from storage are set out in our storage terms.

11. Moving materials

Ordered materials are made available for collection in Spreitenbach after our confirmation or delivered on the terms stated on the website.

12. Payment

Private jobs are paid in cash or by TWINT on site to the team leader once the work is completed or – if agreed – by invoice. Business customers receive an invoice. Invoices are payable net within 10 days unless the quote provides otherwise. A deposit may be agreed in the quote.

After the payment period expires you are in default without reminder and owe default interest of 5 % per year (Art. 104 CO) and the costs of collection.

13. Data protection

How we process personal data, photos and the information on your personal job page is explained in our privacy policy.

14. Final provisions

Amendments and additions to the contract must be made in writing; email and WhatsApp are sufficient.

If any provision of these GTC is invalid, the remaining provisions remain valid. The invalid provision is replaced by the statutory rule.

Swiss law applies. Place of jurisdiction is Baden (Canton of Aargau). Mandatory places of jurisdiction remain reserved, in particular that of the consumer’s domicile (Art. 32 CPC).
