1. Scope
These storage terms apply to storing furniture, household goods and other items in the Umzugsexpress GmbH facility, Zürcherstrasse 320, 8406 Winterthur. Our general terms and conditions and the provisions on warehousing (Art. 482 ff. Swiss Code of Obligations, CO) apply in addition. Deviating agreements are recorded in the quote.
2. Order and storage list
Storage takes place after you accept the quote and we confirm in writing. Tell us beforehand what will be stored and whether it includes particularly valuable, fragile or bulky items.
When storing, we record the type and number of items in a storage list; you receive a copy. For boxes we record the number, not the contents.
3. What we do not store
We do not store: gas cylinders, fuels, paints, chemicals and other flammable or explosive substances; food, drinks, pet food and other perishables; animals and plants; cash, precious metals, jewellery and securities; illegal items.
Carpets, curtains and other textiles are stored only clean and dry, fridges and freezers only defrosted, cleaned and dry. We are not liable for damage resulting from the condition of the goods when stored (e.g. mould, odours, pests).
If such goods are stored nevertheless, you are liable for any resulting damage.
4. Packing
Fragile items such as glass, porcelain, pictures, mirrors and lamps must be packed. For the contents of boxes you packed yourself we are only liable if the box is visibly damaged on the outside or we are at fault. On request we do the packing.
Please tell us beforehand about goods sensitive to temperature or humidity (e.g. musical instruments, paintings, electronics); we will clarify with you whether storage is suitable.
5. Access, partial and final removal
You have access to your goods by appointment, booked at least 24 hours in advance, accompanied by our staff.
On removal we check your authorisation. Third parties collecting goods need your written authorisation.
The work involved in access, partial or additional storage and removal is charged at the rates in the quote unless it provides otherwise. Transport to and from the facility is quoted separately.
6. Prices and payment
The storage fee depends on the volume occupied as per the quote and is payable monthly in advance. If the volume changes through partial or additional storage, we adjust the fee from the following month.
7. Care, liability and insurance
We store your goods with the care of a diligent warehouse keeper (Art. 483 CO), check the facility regularly and inform you immediately if we notice damage or hazards. In urgent cases we take the necessary protective measures.
You insure your goods yourself against fire, water and theft unless the quote provides otherwise. Many household insurance policies cover stored goods only to a limited extent – ask your insurer before storing.
We are liable in accordance with the law. There is no liability for normal ageing, for damage resulting from the condition of the goods when stored or for damage caused by force majeure. Liability for intent and gross negligence is never limited.
Record visible damage or missing items on removal in the presence of our staff; report other damage immediately on discovery, at the latest within eight days, in writing with photos.
8. Duration and termination
If a fixed term is agreed, storage ends when it expires. Otherwise either party may terminate in writing with 30 days’ notice to the end of a month (email or WhatsApp is sufficient).
Storage may be terminated without notice for good cause, for example if the goods give off odours, pests or hazards, or if storage fees due are not paid despite a reminder with a ten-day grace period. We then set you a reasonable deadline for collection.
9. Change of address
Inform us of any change to your address, phone number or email. Notices sent to the last known address are deemed delivered.
10. Right of retention and uncollected goods
For claims due under the storage contract we have a right of retention over the stored goods (Art. 485 CO, Art. 895 ff. Swiss Civil Code). Realisation takes place only in accordance with the statutory provisions.
If you do not collect your goods after storage ends despite a written request, we charge further storage at the previous rates.
11. Final provisions
Swiss law applies. Place of jurisdiction is Baden (canton Aargau). Mandatory places of jurisdiction remain reserved, in particular that at the domicile of consumers (Art. 32 Swiss Civil Procedure Code).
